Infringement Complaint Guidelines

As a neutral online service provider, Xiaohongshu only provides information storage space for users. Xiaohongshu users register, publish content, and offer goods or services independently. Xiaohongshu cannot pre-screen user content for infringement and does not provide any guarantees regarding the content published on the platform.

To help you protect your legitimate rights and interests, Xiaohongshu has formulated and provided these guidelines. Please read them carefully. If you believe that any user, note, product, live stream, etc., on Xiaohongshu infringes upon your legitimate rights and interests, please submit your complaint to Xiaohongshu according to these guidelines.

Please be aware that filing an infringement complaint is a serious legal action. Xiaohongshu reviews and handles infringement complaints in strict accordance with the relevant provisions of the Civil Code, the E-commerce Law, the Regulations on the Protection of Information Network Dissemination Rights, and other relevant laws and regulations. If you fail to exercise your rights as outlined in these guidelines, your infringement complaint will not be accepted.

I. Required Materials for Infringement Complaints

If you need to file an infringement complaint with Xiaohongshu, please prepare the following required materials beforehand:

If you are complaining about multiple instances of infringement or if it is inconvenient to file a complaint through the app for a single instance of infringement, please download the Infringement Complaint Notice template and fill in the required information completely, accurately, and validly.

II. Submitting an Infringement Complaint

After preparing the necessary materials, please submit your infringement complaint to Xiaohongshu through one of the following methods:

1. Complaint Methods for Specific Infringements

Note: Due to the unique nature of selling goods and live streaming on Xiaohongshu, specific submission methods are provided for complaints related to product and live stream infringement.

(1) Product Infringement Complaints:

If you are complaining about product infringement, please email the required materials and the product link to [email protected]. Use the following subject line format: "[Rights Holder's Real Name or Name] + [Type of Infringed Right (e.g., Reputation Right, Privacy Right, Copyright, Trademark Right)]".

(2) Live Stream Content Infringement Complaints:

If you are complaining about live stream content infringement, please email the required materials, the live stream link, the specific time of the infringement, and screenshots or recordings of the infringing content to [email protected]. Use the following subject line format: "[Rights Holder's Real Name or Name] + [Type of Infringed Right (e.g., Reputation Right, Privacy Right, Copyright, Trademark Right)]".

Note: These email addresses only accept the two types of specific infringement complaints mentioned above and cannot process other infringement complaints. For other infringement complaints, please use the methods below.

2. Complaint Methods for General Infringements

If you are complaining about a single note, you can submit your complaint through the app: "App > Click the three-dot icon in the upper right corner of the note > Report > Infringement of Rights." Follow the instructions for real-name authentication and submit the required materials.

If you are complaining about a user or multiple notes, or if it is inconvenient to file a single note complaint through the app, please visit the official Xiaohongshu Rights Protection Center. Follow the on-screen instructions to log in and submit the required materials.

Note: General infringement complaints cannot be submitted via email. The email addresses mentioned in these guidelines, or any email addresses you obtain independently, cannot process infringement complaints.

III. Frequently Asked Questions about Infringement Complaints

Xiaohongshu typically processes infringement complaints within 7 days. However, if your complaint is missing required materials, contains inaccurate links, is submitted through the wrong channel, etc., the complaint will be invalid, and Xiaohongshu will not be able to process it.

3. What language should be used for infringement complaints?

Xiaohongshu only accepts complaints in Chinese. Foreign language complaint documents must include a Chinese translation, and Xiaohongshu will consider the Chinese translation as the official version.

4. Will the personal information submitted in an infringement complaint be disclosed?

Xiaohongshu strictly adheres to personal information protection regulations. The identity verification document and the personal information it contains will only be used for necessary legal procedures, such as forwarding notifications, and will not be disclosed to any other third parties.

Refusal to provide a real identity verification document will invalidate the infringement complaint, and Xiaohongshu will not be able to process it.

Note: After Xiaohongshu takes necessary action in response to a rights holder's infringement complaint, it will forward the complaint to the user against whom the action was taken, as required by law. The forwarded content includes the rights holder's real identity information and preliminary evidence of infringement.

5. If I provide all the required materials, is my infringement complaint guaranteed to be processed?

Xiaohongshu has the right and obligation, within the scope of laws and regulations and the knowledge and abilities of its reviewers, to make judgments and take action regarding users or content targeted in infringement complaints. Xiaohongshu does not make any promises or guarantees regarding the outcome of a complaint. Xiaohongshu cannot remove, block, or disable links to content that is not deemed infringing.

IV. User Appeals

Users who have had action taken against them due to an infringement complaint and believe the claim is unfounded can file an appeal with Xiaohongshu within 5 business days of receiving notification.

1. Appeal Materials

(1) Real Identity Verification Document: Same requirements as for rights holders submitting infringement complaints.

(2) Preliminary Evidence Demonstrating Non-Infringement: Including, but not limited to, proof of intellectual property ownership or usage rights, information network dissemination rights, drafts of the work, timestamps of creation issued by authoritative institutions, work registration certificates, authorization letters, and other valid proof of ownership demonstrating the complained-of party's rights; a statement of reasons why the content does not constitute infringement (direct refutation of the complaint, including denial of facts, explanation of relevant laws and regulations, etc.); evidence demonstrating non-infringement (including, but not limited to, valid proof that the complained-of notes, products, services, or live streams do not infringe upon the rights holder's personal rights, copyrights, trademark rights, or patent rights); a guarantee from the complained-of party (the complained-of party is responsible for the authenticity, validity, and legality of the statements and materials provided in the Non-infringement Declaration and guarantees to bear all losses and legal liabilities incurred by Xiaohongshu due to the restoration of the complained-of notes, products, services, or live streams based on their defense).

(3) Non-infringement Declaration: Download the Non-infringement Declaration template, fill in the required information completely, accurately, and validly, sign or affix the official seal, and provide a clear color scan.

(4) Word or Excel document listing the accurate names, screenshots, and Xiaohongshu links of the frozen or blocked content that you request to be restored.

2. Appeal Method

Email the prepared appeal materials to the appropriate appeal email address, using the following subject line format: "[Appellant's Real Name or Name] + [Type of Infringed Right (e.g., Reputation Right, Privacy Right, Copyright, Trademark Right)]."

Note: Appeals with missing required materials, inaccurate information, or submitted through the incorrect channel will be considered invalid and will not be processed by Xiaohongshu.

After receiving a user appeal, Xiaohongshu will promptly review it and forward the appeal (including the appealing user's real identity information and preliminary evidence of non-infringement) to the rights holder.

If the appealing user's reasons and evidence are sufficient, Xiaohongshu may decide to lift or cancel the measures taken. If the rights holder disagrees with the lifting or cancellation of the measures, they can file a complaint with the relevant authorities or file a lawsuit with the people's court.

If Xiaohongshu does not receive notification of a lawsuit or notice of intent to sue from the rights holder within 15 days of forwarding the appeal, the measures taken will be lifted or canceled.

Xiaohongshu does not make any promises or guarantees regarding the outcome of rights holder complaints or user appeals. These Infringement Complaint Guidelines are effective upon publication. Xiaohongshu reserves the right to modify these guidelines within the scope permitted by law.
